By booking or boarding Capri you agree to these terms. Boat Capri Sydney is operated by Bizfunfu Pty Ltd trading as Sydney Charter Boat Hire (ABN 72 150 519 208) — “we” or “us”. “You” means the person who makes the booking (the hirer) and everyone on board.
1. Who we are
Capri is a hire-and-drive vessel operated by Bizfunfu Pty Ltd trading as Sydney Charter Boat Hire. Our hire-and-drive licence number is HD-0717 (TBC — as published on our previous site). We operate from Le Montage wharf, Maliyawul St, Lilyfield NSW 2040.
Contact: text or call 0431 506 644, or email boatcaprisydney@gmail.com. For incidents during a hire, text 0414 260 078.
2. Booking and payment
Bookings are made online and paid in full by card at the time of booking. We do not hold dates without payment.
- The self-drive hire is $360 for three hours for the whole boat, up to 8 people including children.
- Extra hours are $100 each, to a maximum of eight hours in total, added at booking or by text during the hire if the boat is free.
- Add-ons with a confirmed price (boat-licence practical training, $149) are paid at booking. Add-ons without a published price (catering, skippered upgrade) are quoted by text and charged only once you accept the quote.
- Payment is processed by Stripe. You receive a confirmation and receipt by text and email.
- Your booking is for the date, start time and hours shown on your confirmation. Hire time starts at the booked start time, after the induction.
- Prices include GST where applicable and may change for future bookings; the price you paid is the price for your booking.
3. Bond, excess and extra charges
A $200 bond applies to every hire. How the bond is taken and released (card pre-authorisation or on the day) is TBC and will be stated on your confirmation.
- You agree to pay the insurance excess of $1,000 in the event of an accident or damage to the vessel or to third parties while it is in your care.
- Damage caused by a breach of these terms (for example towing, driving onto rocks or ramps, or an unlicensed and un-nominated driver) may be charged in full.
- Late returns are billed at twice the hourly rate, because the next group is waiting.
- Instructor waiting time is charged at $1 per minute if you or your group arrive late or delay the induction.
- A rescue call-out (for example running out of fuel or grounding) incurs a fee of no less than $100 plus costs.
- Equipment lost or removed from the vessel is charged at replacement cost.
4. Weather, cancellation and changes
Our weather and cancellation policy is set out in full on the Weather policy page and forms part of these terms. In summary: we check the Rozelle Bay wind forecast at 7am on the day. If it is forecast at 25 km/h or more, a BOM warning is in effect, or the temperature is below 15 °C, we call the hire off and you may reschedule for free or take a full refund.
If you change your mind: seven or more days before the hire, a full refund less payment fees; three to seven days before, a 50% refund or a free reschedule; under 72 hours, a reschedule credit only.
We may cancel or cut short a hire for safety or mechanical reasons. If we do, we offer a reschedule or a credit for the time missed (pro-rata terms TBC).
This is the unified policy we are adopting for the new site. It is pending the owner’s final ratification; until then the version shown at the time you book is the one that applies to your booking.
5. Who can drive
Capri is under 7.5 m and operates under 10 knots, so no boat licence is required. The following conditions apply to every driver.
- Drivers must be 18 or older and show photo identification (a current driver licence or passport) at the wharf.
- Only drivers nominated before the hire and inducted or briefed by us may operate the vessel.
- Drivers without an Australian boat licence complete a 30-minute practical induction before the hire starts. Licensed drivers receive a safety briefing.
- A 0.05 blood alcohol limit applies to the driver at all times. Drug and alcohol laws apply on the water as on the road.
- Drivers must understand and follow NSW Maritime rules, our navigation limits and the instructions given at the induction. Failure to do so may result in the hire being ended without refund.
6. Safety and induction
You are responsible for the safety of yourself and everyone on board at all times.
- All participants must watch the power-boat induction video before the hire (link in your confirmation), and the hirer must ensure every driver and crew member has understood it before boarding.
- Everyone on board is briefed on emergency and man-overboard procedures at the wharf. Anyone who has not been briefed must not operate the vessel.
- Tell someone your plans before departure, ask them to call 000 if you do not return on time, and let them know when you are back.
- Children under 12 must wear a lifejacket at all times. Type 1, 2 or 3 lifejackets apply on enclosed waters. Tell us children’s ages when you book so the right sizes are on board.
- Lifejackets for every person, a first aid kit and the safety equipment required by NSW Maritime are on board. The vessel carries GPS tracking.
7. On the water
Capri is licensed for hire in daylight hours on partially smooth waters only.
- Stay inside the hire area: from Gladesville Bridge in the west to Bradleys Head and Point Piper in the east, excluding Circular Quay and Sydney Cove, Woolloomooloo Bay, the Balls Head and Manns Point exclusion zones and all major ferry terminals. The map you are given at the induction is definitive.
- Obey all speed limits, no-wash zones, distance rules and other NSW Maritime regulations.
- Maximum 8 people on board, including children.
- No towing of people, tubes or boards. Do not drive onto rocky areas, beaches or ramps.
- Keep the waterways clean: use the bin provided; nothing goes overboard.
- No smoking on board — fuel is stored on the vessel. No BBQ, no fishing, no shoes on deck.
- Keep music at a reasonable level near moorings, swimmers and the shore.
- Anchor or moor only where permitted and shown at the induction; never leave the vessel unattended.
8. Inspection and incident reporting
- Inspect the vessel before boarding and tell us about any missing or damaged equipment before departure.
- Report every incident — accident, breakdown, injury or equipment loss — immediately by text to 0414 260 078, including who was driving, what happened and the details of anyone else involved.
- Do not attempt repairs. Wait for our instructions.
9. Responsibilities and liability
We provide a vessel that is seaworthy and suitable for hire. Conditions on the harbour can change without warning, and navigation of the vessel during the hire is your responsibility.
To the extent permitted by law, we are not liable for loss, damage or injury arising from faulty navigation, unsafe practices, disregard of our instructions or rough conditions during your hire. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
You agree not to tamper with, damage or remove any equipment from the vessel, and to pay for any damage you cause as set out in section 3.
10. Creator Hour
Creator Hour is a free fourth hour, valued at $100, offered to people who apply before booking and post about their day. Default expectations (TBC by the owner): one Reel or TikTok tagging @capri.down.under within seven days of the hire, plus three stories on the day, from a public account.
- Applications are approved at our discretion by reply; approved applicants receive a single-use code for the booking form.
- The free hour is subject to availability and weather and applies once per booking. It has no cash value and cannot be exchanged for a refund.
- You keep ownership of your content. You grant us permission to reshare it with credit on our website and social channels; you may withdraw that permission at any time by emailing boatcaprisydney@gmail.com and we will remove it within 14 days.
- If the agreed content is not posted, we may charge the standard $100 for the fourth hour.
11. Catering and add-ons
Catering (sushi, ice and prosecco) must be pre-booked at least 48 hours before the hire. Prices are confirmed by text before anything is charged. Tell us dietary requirements when you order. BYO food and drink is always welcome; the driver stays under 0.05.
Boat-licence practical training ($149) is booked as an add-on and runs on Capri for about two hours. The knowledge test is completed separately with Service NSW. Process details are TBC against current Transport for NSW requirements.
12. Photos and content
We photograph and film the boat and the wharf for our own website and social channels. We ask before publishing images in which you are identifiable, and you can decline. Photos you share with us or tag #capridownunder are only republished with permission on file; see the Privacy policy for how to withdraw it.
13. Changes to these terms
We may update these terms from time to time. The date at the top shows the current version. The version shown at the time you book applies to your booking.
